Price and booking

The Agence les Mimosa offers are non-binding and are made subject to possible changes, unless otherwise stipulated in writing. All mentions on the website are supposed to be relevant subject to possible changes. Agence les Mimosas cannot be held responsible for the obvious faults appearing on its website. Prices include VAT but exclude any fees. Additional costs such as administration, cleaning, cancellation, travel and residence taxes (set by local authorities) are listed separately.

Bookings can be made by phone or email to ensure the availability of the requested period. The tenant receives by e-mail a rental agreement that acts as an invoice and terms and conditions. A signed copy of the booking contract must be immediately returned to Agence les Mimosas, 1334 Boulevard du Littoral, 83420 La Croix Valmer, France. The booking becomes effective once the tenant has also sent the deposit within 7 days to Agence les Mimosas. Agency les Mimosas has the right to refuse a reservation without indicating the reason.

Payments

The payment is made as follows:

  1. The down payment (25% of the amount of the accommodation) and the costs of tourism insurance are to be paid no later than 7 days after the booking is made.
  2. The balance (75% of the amount of accommodation) is to be paid no later than 4 weeks before the start date of the rental.
  3. The cleaning fee, the tourist tax, the security deposit (guarantee, caution) and other benefits are to be paid upon arrival.

If you proceed to a money transfer; please provide proof of this transfer. On the day of your arrival, payment can be made by credit card or cash. No key will be issued without payment of full rent and ancillary costs. IBAN: FR13 3000 2039 5400 0008 1209 K68 – BIC: CRLYFRPP.

Cancellation and modifications

The tenant is entitled to proceed to a cancellation, for the payment of the following charges and cancellation fees: a/ In case of cancellation up to 42 day prior to the travel date:  25% of the rent; b/ In the event of cancellation between the 42nd up to the 28th day prior to the travel date: 60% of the rent; c/ In case of cancellation occurring between the 28th day up to the first day of travel date: 90% of the rent; d/ In case of cancellation occurring on the first day of the stay or later: the full rent. The date of receipt of your letter or email is decisive for the answer to the question whether the cancellation was made within the allotted time. The cancellation of a reservation by the main tenant also takes place of cancellation at the expense of the roommates. In the event of an unpaid bill, all the costs of the procedure and execution, as well as the costs of an out-of-court bailiff, are attributable to the tenant. The extrajudicial bailiff's fee amounts to at least 15% of the bill with a minimum of 100 euros.

For 1 € Agence les Mimosas offers a tourism insurance included in the rent. The tenant has the possibility to refuse this additional euro; in the event of a withdrawal he will then be opposed to the above mentioned terms and conditions  

Cancellation by Agence les Mimosas: Price changes and/or changes in the rental conditions after the conclusion of the rental agreement are unlikely. However, if for unforeseen reasons, key points of the rental agreement need to be changed, the tenant has the right to cancel the reservation within 7 days after receiving the letter informing him of the changes in the conditions. All the sums paid will then be refunded. Agence les Mimosas is not required to pay compensatory compensation in any form.

Guarantee deposit

On the day of arrival, the tenant must pay the security deposit. The security deposit can be paid by pre-authorization credit card (pre-authorization is automatically cancelled after 4 weeks) or by cheque. This amount will be refunded no later than 4 weeks after your departure, net of the replaced items, any costs of rehabilitation, additional cleaning and the amount of consumption. If the security deposit proves insufficient, the taker agrees to complete the sum.

Tenant's rights and obligations during stay

Alternatively, to these conditions and the rental agreement, condominium regulations may apply.

Unless otherwise stipulated in the rental agreement, the arrival of the tenant and the receipt of the keys are always between 16:00 and 18:00. In case of an arrival at a time other than between 4 and 6 p.m., the tenant will inform Agence les Mimosas and agree with him about another arrival time. Unless otherwise stipulated in the rental agreement, the departure of the property is always at the time indicated on the rental agreement. The agency does everything possible to prepare the rented premises for 4pm but is never held responsible for the consequences of a departure after the specified time. If the tenant exceeds the time of departure mentioned in the rental agreement, the entire security deposit will be withheld, he will be required to pay the additional rental days and the damages resulting from his departure not in accordance with that of his rental agreement. The tenant accepts that the property has been restored to him in good condition, unless claims are made in writing within 6 hours after receiving the keys. The tenant undertakes to live in the premises bourgeoisly and is held civilly responsible for the damage caused to the rented property or its inventory. If the tenant causes damage, he will immediately inform Agence les Mimosas. Repairs or expenses resulting from this damage must be reimbursed immediately, on the spot, by the tenant. The principal tenant is also, civilly responsible for the damage caused by him, another tenant or a possible visitor in the event that this damage is found after his departure. The renter is obliged to insure against the risks of fire, theft and water damage, both for the furniture given for rent and for its rental risks for the remedies of the neighbors. The tenant should absolutely refrain from throwing in the sink, bathtub, bidet, sink, wash house, toilet, etc. objects that can obstruct the pipes, otherwise it will be liable for the costs incurred for the re-commissioning of these devices. Agency employees are allowed to enter the rented premises at any time but the agency will do its best to notify the tenant.

Agence les Mimosas will not be held responsible for the misuse of pool safety devices. The tenant is required to use the pool safety features as required by the DGCCRF. The safety features for swimming pools are in no way a substitute for the vigilance of tenants, who must be aware of the safety instructions specific to each device. To prevent drowning, it is important to recall some prevention tips: - monitor children carefully and consistently to ensure their safety; - never let a child access the pool alone; - activate the safety device at the end of the swim to make the pool inaccessible to children.

Only the pets listed on the rental agreement will be accepted in the house. It is forbidden to make use of mobile homes, caravans, or tents in the garden of the rented property. It is not allowed to occupy the property with more people (including children) than the maximum number of people stipulated in the rental agreement.

Upon departure, the tenant agrees that the house will be tidy. The kitchen must be clean: the dustbins emptied, the washing up done, the dishwasher emptied, and the furniture must be put back at the same place as it was at arrival. Agence les Mimosas keeps the right to check the state of the premises at the end of the stays. In case of negligence, additional (cleaning) costs may be charged to the tenant.

Termination of the rental agreement.

Agence les Mimosas keeps the right to terminate the rental agreement without compensation in the following cases: (a) the tenant, despite the summonses sent in writing, has not complied with important obligations arising from these conditions or the rental agreement; b) the tenant does not respect the rented accommodation as well as his environment, including noise, during his stay in the rented accommodation, even after warnings from Agence les Mimosas.

Complaints

In case of problems found on arrival or during the stay, the tenant is required to contact Agence les Mimosas immediately (within 6 hours of arrival). Agence les Mimosas will do everything possible to solve the problem on the spot with the tenant.

Responsibilities

Agence les Mimosas cannot be held responsible in case of force majeure and can in this case dissolve the rental agreement without the tenant being able to claim compensation or restitution rights. If force majeure occurs during the stay, so that the tenant has only been able to stay in the holiday home partially, the rental contract is supposed to be dissolved for the period also begun, even if the tenant can establish the real deprivation of enjoyment of the rented accommodation. Agence les Mimosas cannot be held responsible for any inconvenience suffered by the tenant or by third parties resulting from the stay in the holiday home; the tenant cannot blame Agence les Mimosas. More specifically, Agence les Mimosas is not responsible for construction activities in the direct vicinity, inventory changes carried out by the owner that have not been brought to his attention, temporary water cuts, energy resources, internet connection, swimming pool, etc. The responsibility of Agency les Mimosas can only be incurred in cases of serious misconduct or because of the negligence of Agence les Mimosas. Unless otherwise stated, the responsibility of Agence les Mimosas may be incurred as the only judicial official according to the rental agreement. This responsibility is always limited to direct damage and excludes any form of indirect damage. The liability of A Agence les Mimosas is always limited to the maximum amount that the insurer of Agence les Mimosas will pay if necessary. Tenants must be covered by personal liability insurance and the agency advises them to take out cancellation and travel insurance.

  • Handing over the key to third parties at the agency with validation message 20 euros
  • Check of a property: check if the house has been properly closed, if the alarm is working, the water is cut off, the garden furniture entered... €30 travel costs in the commune of La Croix-Valmer and 75 € per hour.
  • Ad hoc intervention by a housekeeper 30 € per hour.
  • Receipt of parcels at the office is 30 € per parcel and 30 € per hour of waiting outside the office hours and 30 € per hour for waiting on site (e.g. furniture delivery).
  • Follow-up of renovation work: progress control and photo-taking.
  • Laundry management
  • Outsourcing: search for a supplier and presentation of 3 offers: 30 euros per quotation.
  • Outsourcing assistance: opening and closing of the accommodation and coordination of the provider 30 € travel costs in the commune of La Croix-Valmer and 75 € per hour

For shared use a swimming pool with a children's wading pool; 12.5m x 25m, depth 130cm-260cm, opening hours 10:00-19:00, the pool is supervised by a lifeguard in July and August. Costs: adults 2€ and children over 7 years 1€ a day, package 10€ per week.

Tennis: 4 tennis courts (a contribution fee is requested for tennis court access). 

Internet: free access to an internet connexion at the Clubhouse (pool).
